Memorandum

It is critical to the continued maintenance and operation of home appliances and other vital consumer electronics in U.S. households. Among other critical operations, Samsung helps to repair televisions, mobile devices, and home appliance products used for cooking, refrigeration, and laundry that millions of Americans are relying on while state and local orders remain in-effect during the COVID-19 pandemic. These services are essential so that Americans can remain healthy, safe, connected and informed in their homes.

On March 16, 2020, President Donald Trump issued updated Coronavirus Guidance for America. This guidance states that: “If you work in a critical infrastructure industry, as defined by the Department of Homeland Security, you have a special responsibility to maintain your normal work schedule.” On March 19, the U.S. Department of Homeland Security’s Cybersecurity and Infrastructure Security Agency (CISA) issued an initial list designating “Essential Critical Infrastructure Workers” needed to maintain the services and functions Americans depend on daily and need to be able to operate resiliently during the COVID-19 pandemic. State and local health orders similarly recognize that essential critical infrastructure and essential businesses must be maintained.

CISA’s designation of Essential Critical Infrastructure includes:

• Employees and firms engaged in maintenance of communications infrastructure, including (among other things) technicians, operators, wireline and wireless providers, and manufacturers and distributors of communications equipment.

• Installation, maintenance, and repair technicians that establish, support, or repair communications services as needed.

• Service centers, field engineers, and other technicians supporting critical infrastructure, as well as manufacturers and supply chain vendors that provide hardware and software and information technology equipment for critical infrastructure.

• Workers who provide services that are necessary to maintaining the safety, sanitation, and essential operation of residences.

• Employees engaged in the manufacture and maintenance of equipment and other infrastructure necessary to agricultural production and distribution.

• Workers necessary for the manufacturing of materials and products needed for supply chains associated with transportation, energy, communications, and food and agriculture, as well as workers needed to maintain the continuity of these manufacturing functions and associated supply chains.

This letter certifies that Samsung’s operations, described above, are part of a complex and necessary supply chain that supports the continuing function of Essential Critical Infrastructure as defined by CISA.

Your company is part of that essential supply chain too: You provide products or services that will enable Samsung to maintain Essential Critical Infrastructure during the Coronavirus (COVID-19) pandemic.

While national, state, and local guidance and orders require maintenance of essential critical infrastructure, they simultaneously seek to ensure that the maximum number of people self-isolate. These directives accordingly provide that when people need to leave their places of residence—whether to obtain or perform vital services, or to otherwise facilitate authorized activities necessary for continuity of social and commercial life—they should at all times reasonably possible comply with social distancing requirements.

In the past weeks, Samsung and its components have taken a number of steps to protect the health and safety of its employees consistent with State and local health orders. For example, Samsung has:

• Encouraged telework for those who can work remotely.

• Required social distancing policies and practices in the workplace.

• Increased cleaning and disinfection of our workplaces, including frequent cleanings of bathrooms, common areas, elevators, door handles, levers, buttons, touch screens and other common area surfaces in SEA facilities.

• Limited meetings and non-essential interactions among employees.

• Leveraged flexible workplace policies regarding sick and family care leave.

We recognize the unique and extraordinarily difficult circumstance we are in. But we think that public health, social, and commercial continuity goals can be achieved through stringent and prudent precautions. The situation requires all of us to actively work together to prevent the spread of Coronavirus. We accordingly ask our business partners to follow the guidelines Samsung has instituted above to the greatest extent possible.

Even more importantly, our business partners should ensure that, if one of their personnel is not feeling well, has come into contact with anyone who is ill, or has come into close contact with someone who has a suspected or confirmed case of Coronavirus, the individual self-quarantines, contacts their medical provider, and does not come to work. We also ask that you ensure all of your personnel who travel for work do so safely and in compliance with all recommendations from the Centers for Disease Control and local public health authorities.
